2. Services Description

2.1 Archieboy Holdings, LLC. provides a platform that allows users to clone their voices and utilize pre-existing cloned voices for personal and commercial use. By using our Services, you acknowledge and agree that any voice cloning conducted must be done with proper permission, in compliance with applicable laws and regulations.

2.2 We do not guarantee the availability or uninterrupted operation of our Services, and we reserve the right to modify, suspend, or terminate any aspect of the Services at any time without notice. We are not responsible for any loss of data or other damages that may result from such actions.

3. User Obligations

3.1 You are solely responsible for obtaining all necessary permissions, consents, and rights from third parties to clone their voices. You agree not to clone the voice of any individual without their explicit consent, unless you have the legal authority to do so.

3.2 You agree to use our Services only for lawful purposes and in accordance with these Terms and Conditions, applicable laws, and regulations. You shall not use the Services to infringe upon the intellectual property rights or privacy rights of others.

3.3 You are solely responsible for your use of the Services and any consequences thereof. We are not responsible for the behavior, actions, or content uploaded by our users.

4. Dispute Resolution

4.1 Any dispute arising out of or relating to this Agreement or your use of our Services shall be governed by the laws of the state of Massachusetts, United States, without regard to its conflict of laws principles.

4.2 Any legal action or proceeding arising out of or relating to this Agreement or your use of our Services shall be exclusively brought in the state or federal courts located in Massachusetts, United States, and you consent to the personal jurisdiction of such courts.

5. Limitation of Liability

5.1 To the maximum extent permitted by applicable law, Archieboy Holdings, LLC. and its affiliates, directors, officers, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, lost profits, lost data, or business interruption arising out of or in connection with the use of our Services.

5.2 In no event shall our total aggregate liability exceed the amount paid by you, if any, for accessing or using our Services during the three (3) months preceding the date of the claim.

5.3 It is your responsibility to check with any retailers you plan to submit to if they allow AI generated voices. We make no guarantees that any retail will accept an AI audiobook.

6. General Provisions

6.1 These Terms and Conditions constitute the entire agreement between you and Archieboy Holdings, LLC. with respect to the subject matter hereof and supersede all prior oral or written understandings, communications, or agreements.

6.2 If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

6.3 Our failure to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

6.4 You may not assign or transfer this Agreement, by operation of law or otherwise, without our prior written consent.
